第一章

  

   第一条 为了保护未成年人的身心健康,保障未成年人的合法权益,促进未成年人全面发展,根据《中华人民共和国未成年人保护法》、《中华人民共和国预防未成年人犯罪法》和有关法律、行政法规,结合本省实际,制定本条例。

  第二条 本条例所称未成年人是指未满十八周岁的公民。

  第三条 保护未成年人工作,应当遵循尊重人格尊严、平等对待,适应未成年人身心发展规律和特点,教育与保护相结合的原则。

  对未成年人享有的生存权、发展权、受教育权、受保护权、参与权等权利,应当给予特殊、优先保护。

  第四条 国家机关、武装力量、政党、社会团体、企业事业组织、城乡基层群众性自治组织、未成年人的监护人和其他成年公民,都有责任关心、培养、教育未成年人,优化未成年人成长环境,保障未成年人合法权益。

  第五条 省、市、县(市、区)人民政府(以下简称县级以上人民政府)应当做好未成年人保护工作,将未成年人保护工作纳入国民经济和社会发展规划及年度计划,组织制定和实施未成年人保护工作规划,并将相关经费纳入本级财政预算。

  教育、公安、民政、司法行政、人力资源和社会保障、环境保护、住房和城乡建设、文化、卫生、工商、广播电影电视、新闻出版、通信管理等部门以及人民检察院、人民法院,应当在各自职责范围内,做好未成年人保护工作。

  乡(镇)人民政府、街道办事处应当采取有效措施,做好未成年人保护工作。

  第六条 共青团、妇女联合会、工会、残疾人联合会、青年联合会、学生联合会、少年先锋队、红十字会、关心下一代工作委员会以及其他有关社会团体和村(居)民委员会等组织,协助各级人民政府保护未成年人做好工作,维护未成年人的合法权益。

  第七条 省、市、县(市、区)设立未成年人保护委员会,负责协调、指导和监督未成年人保护工作,具体职责是:

  (一)宣传有关未成年人保护法律、法规和政策,并对其实施情况进行监督、检查;

  (二)调查、评估本行政区域未成年人保护状况,协调、指导未成年人保护工作;

  (三)研究未成年人保护工作中的重大问题,并向有关部门、机关提出建议和意见;

  (四)受理侵害未成年人合法权益的投诉、举报,督促有关部门及时处理,协调有关部门为未成年人提供或者寻求法律帮助;

  (五)做好有关未成年人保护的其他工作。

  未成年人保护委员会办事机构设在同级共青团组织,负责日常工作。

  乡(镇)、街道根据需要设立未成年人保护委员会。

第八条 未成年人应当接受家庭、学校、国家机关和社会的教育,增强明辨是非和自我保护的意识、能力。对于侵犯自己合法权益的行为,未成年人有权提出检举、控告和申诉,有关国家机关应当依法及时处理。

 

 

Chapter I

  General Provisions

Article 1 This Law is enacted in accordance with the Law of the People's Republic of China on the Protection of Minors, the Law of the People's Republic of China on the Protection of Minors Prevention of Juvenile Delinquency, relevant laws, administrative regulations and this province’s actualities for the purpose of protecting the physical and mental health of minors, safeguarding their lawful rights and interests, promoting their all- round development.

  Article 2 Minors as used in this Ordinance refer to citizens under the age of eighteen.

  Article 3 The protection of minors shall follow the following principles: respecting their personal dignity and treating them equally; fitting in with the law and characteristics of minors' physical and mental development; and combining education with protection.

  Special and preferential protection shall be given to minors’ rights to survival, development, education, protection and participation.

Article 4 State organs, armed forces, political parties, social organizations, enterprises and institutions, self-governing organizations of mass character at grass- roots levels in urban and rural areas, guardians of minors and other adult citizens are responsible for caring for, cultivating and educating minors, optimizing their growth environment and safeguarding their lawful rights and interests.

Article 5 The people's governments of provinces, cities and counties (cities and districts) (hereinafter referred to as the people’s governments at county level and above (PGCLA)) shall protect minors properly, incorporate the protection of minors into their planning for national economy and social development and annual plan, organize the formulation and implementation of the planning for the protection of minors and incorporate relevant funds into their financial budget.

  Educational, public security, civil administration, judicial and administrative, human resources and social security, environmental protection, housing and urban construction, cultural, health, industrial and commercial, broadcast, film and TV, journal and communications administration departments, the people’s procuratorates and the people’s courts shall protect minors properly to the extent of their respective duties.

  The people’s governments of townships (towns) and subdistrict offices shall take effective measures to protect minors properly.

Article 6 The Communist Youth League organs, women's federations, trade unions, youth federations, students' federations, young pioneers' organizations, the Red Cross, the committees for the wellbeing of the youth, other social organizations and villagers’ (neighborhood) committees shall assist the people's governments at various levels in ensuring the protection of minors and safeguarding their lawful rights and interests.

Article 7 Provinces, cities and counties (cities and districts) establish committees for the protection of minors to be responsible for coordinating, instructing and supervising the protection of minors, whose specific duties include the following:

  (I) Publicizing laws, regulations and policies related to the protection of minors and supervising and inspecting their implementation;

  (II)     Investigating and assessing the protection of minors within their respective administrative regions and coordinating and instructing the protection of minors;

  (III) Studying major problems on the protection of minors and proposing suggestions and advice to relevant departments and organs;

  (IV) Accepting any complaint or report against infringement upon the lawful rights and interests of minors, urging relevant department to handle it in time and coordinating relevant department in providing or seeking legal assistance for minors; and

  (V) Do other work related to the protection of minors.

  The offices of the committees for the protection of minors are located the Communist Youth League organizations at the same level, to be responsible for routine work.

  Townships (towns) and subdistricts establish committees for the protection of minors in accordance with the need.

  Article 8 Minors shall accept the education of families, schools, state organs and society and enhance their consciousness and capacity of distinguishing between truth and falsehood and self-protection. In case of infringement upon their lawful rights and interests, minors shall be entitled to report or make an accusation or complaint against it and relevant state organ shall handle it in time in accordance with the law.
